The contracting parties provide for the exercise of the secretarial functions of this agreement, taking into account existing arrangements under other international agreements relating to the prevention of marine pollution and air pollution in the same region as this agreement. Article 218, paragraph 6, of the Treaty on the Functioning of the European Union (TFUE) provides that “the Council, on the proposal of the negotiator, adopts a decision on the conclusion of the agreement.” In addition, this article provides that the Council, unless agreements deal exclusively with the common foreign and security policy, with the decision to conclude the agreement, after approval by the European Parliament, when the agreements cover areas subject to either the ordinary legislative procedure or the special legislative procedure, where the European Parliament`s compliant opinion is necessary. . 3. Surveillance as an aid to the detection and control of pollution covered by paragraphs 1 and 2 of this article and to the prevention of violations of pollution control rules. The adoption of the decision to amend the extension of Bonn`s mandate for Schedule VI of the MARPOL agreement would improve joint monitoring, monitoring and notification of vessel emissions in the North Sea region. Such coordinated action under the agreement would help reduce risks to the marine environment and the interests of coastal states and the EU.
(ii) from this point follows the western border of the pollution liability zone in the Irish Sea (d. h. a line at each point 200 nautical miles from the point closest to the baselines defined for maritime legal purposes, from 1959 to 1988, from Ireland) to 56-42` 00.00″ N 14-00- 00.00 W; The preamble to the agreement is amended as follows: the words “The Kingdom of Spain” are inserted before the words “kingdom of Sweden.” In order to improve cooperation and coordination between States Parties in the fight against illegal air emissions caused by shipping, in order to limit the negative effects of the incineration of marine fuels high in sulphur or nitrogen on human health, biodiversity and the marine environment as a whole. . The material legal basis for a decision under Article 218, paragraph 6 of the TFUE depends first of all on the purpose and content of the proposed act, which is the subject of a position on behalf of the Union. If the proposed action has two objectives or has two elements, and one of those objectives or elements is considered to be the main objective, while the other is only marginal, the decision under Article 218, paragraph 6, of the EUF must be based on a single material legal basis, i.e. the basis required by the main objective or the main objective or element. The text of these amendments is contained in the two decisions adopted by the parties, which are attached to this decision.
